Statement on The Supreme Court’s Tariff Decision

Washington D.C. — Foreign Policy for America welcomes today’s Supreme Court decision in Learning Resources v. Trump. This decision affirms that the authority to impose tariffs belongs to Congress, and that the Trump Administration’s sweeping, baseless abuse of emergency powers to unilaterally impose its agenda cannot continue unchecked.

The ruling affirms and builds on recent bipartisan votes in Congress disapproving these tariffs. Lawmakers in both parties recognize that the sweeping and indiscriminate weaponization of tariffs against allies and major trading partners have imposed extraordinary costs on American families and businesses.

Tariffs remain an important tool, when used strategically, to counter unfair trade practices and strengthen U.S. competitiveness. But it is essential that both the letter and spirit of today’s decision are upheld. This ruling should not be treated as an invitation to repackage the same costly policies under different authorities. Congress and the Administration should instead focus on advancing a coherent, forward-looking trade framework that lowers costs for American families, strengthens competitiveness, and restores U.S. credibility with allies and trading partners.
